AASDN PRIVACY POLICY
- Introduction
1.1 The Australian Automotive Service Dealer Network East Coast Limited (AASDN, we, us, our), a company limited by guarantee formed to provide support, training and mentoring to motor vehicle workshops, is committed to treating your personal information in accordance with the Privacy Act 1988 (Cth) (Act) and the Australian Privacy Principles (APPs) as set out in the Act.
1.2 To comply with our obligations under the APPs, AASDN has a privacy policy which sets out how we manage privacy in our organisation. Our privacy policy is set out in this document. Further information may be obtained by calling or writing to AASDN (see below for contact details).
1.3 AASDN will review this policy from time to time in order to update and continually improve our processes. If this policy is amended at any time, the updated version will be posted on our website at https://aasdneastcoast.com.au/. - Personal Information
2.1 Personal information is defined under the Act as information or an opinion about an identified individual or an individual who is reasonably identifiable, whether the information or opinion is true or not and whether recorded in a material form or not. Sensitive information is a type of personal information that includes health, genetic or biometric information, or information or an opinion which indicates racial or ethnic origin, religious beliefs or affiliations, membership of a trade union, profession, trade association or political association, political or philosophical opinions, sexual orientation or practice, or criminal record.
2.2 For the purpose of this policy, personal information and sensitive information we may collect, hold, use and disclose includes, but is not limited to the following:
(a) name, address, email and contact details;
(b) business information, including your name and the name of the business you represent, the key contact names, email addresses and positions of persons within the business, and the email address, postal address, location, website address and telephone number of the business;
(c) opinion on current industry matters and connected matters;
(d) information in identification documents (e.g. driver’s licence);
(e) date of birth and gender;
(f) bank account details;
(g) financial information and financial status;
(h) transaction history, for example use of our services;
(i) your image on film or photograph if you attend one of our events;
(j) feedback and responses to surveys and/or promotions; and

How we collect your information:
3.1 When practicable, personal information will only be collected from the individual concerned.
3.2 We collect information directly from you using various means, including:
(a) by telephone or email;
(b) when you visit or use our website or software application (app);
(c) by completing our membership forms, other forms and surveys;
(d) in person or in writing;
(e) submitting feedback on business and the industry;
(f) attending our events or attending industry events; and
(g) in the course of supplying our services to you.
3.3 We receive information indirectly, including:
(a) through publicly available information, for example company registers or public business directories;
(b) your authorised representatives;
(c) third parties providing services to us or our members, for example vehicle service and repair training providers for training events arranged by us for our members; and
(d) third parties you purchase goods and services from directly for the purpose of rebates provided to us to support our objects and functions, such as providing member services.
3.4 We also use WhatsApp and Facebook to communicate with our members. If you communicate with us or other members using our WhatsApp or Facebook page, we collect that information. Whatsapp and Facebook have separate privacy policies available here: WhatsApp and Facebook.
The reason we collect, hold and use your information:
3.5 We aim to only collect personal information or sensitive information necessary to carry out our objects and functions under our company constitution, including to provide services to our members, to increase revenue for AASDN to support our objects and functions (includingthrough commercial transactions with third parties), to participate and engage in industry matters, to comply with our regulatory obligations and for corporate governance purposes.
3.6 We collect, hold and use your personal information for the following purposes:
(a) to carry out our objects and functions under our company constitution;
(b) to identify you;
(c) to create and manage your membership;
(d) to provide information on the members directory to enable members to network and for
member business purposes, for example, to identify tools members may have available for
hire and special services members may supply;
(e) to provide our services to you and improve our services;
(f) to provide you with business and industry information;
(g) arrange training events and other industry and membership events;
(h) to increase our revenue to support our objects and functions, including by arranging rebates
or other commercial benefits under commercial agreements we have with third parties (for example, third parties from whom you may purchase goods and services directly);
(i) promotional purposes and sending marketing materials to you;
(j) to contact you for market feedback purposes, to obtain your opinion on current industry matters, business matters, vehicle service and repair matters, and the development of new products and services;
3.7 If you do not provide us with your personal information, we may not be able to provide you with all of our services. It may also affect your use of the website or app. However, if you do not want your personal information to be used in this way, you may opt-out by contacting us and requesting to opt-out at any time.
Photography and film:
If you attend our events, such as the training events, you may be filmed or photographed, which
may be used to report on the event, to promote such an event in future or to promote us,
including on our the publicly available website, app or in communications with our members,
or in a publicly available third party industry magazine, newsletter, other communication or
website. If you do not wish to be filmed or photographed at an event facilitate by AASDN, please
let us know and also let our staff at the event know. If it is reasonably practicable to do so we
will obtain your consent.
Providing us with third party information:
If you provide us with personal information about another person, you must only do so with
their consent and you warrant that the other person is aware of this privacy policy and any
applicable privacy collection notice. - Disclosure of personal information
4.1 We may disclose your personal information to our employees, officers, related bodies corporate
and third parties as reasonably necessary for the purposes set out in Part 3 of this privacy policy
(above).
4.2 The third parties to whom we may disclose your personal information to include:
(a) third party service providers to whom we outsource some of our functions and events;
(b) third party service providers who provide member services directly to our members, such
as the Australian Automotive Aftermarket Association, The Automotive Technician and
DiagnoseDan TSB;
(c) third parties under the terms of commercial agreements we enter into with them, for
example third parties from whom you purchase goods and services;
(d) third parties for the purpose of promoting us, our events, our members or industry matters,
in publicly available industry magazines, newsletters, other communications or website;
(e) insurers, assessors, and underwriters;
(f) professional advisers and consultants (such as lawyers, accountants, and auditors);
(g) government and regulatory authorities, as required by law and/or in the course of providing
our services to you; and
(h) website hosts.
4.3 We may also disclose your personal information to a third party where authorised by you, where
permitted or required by law or where you have otherwise consented. - Disclosure to overseas recipients
5.1 We may disclose your personal information to third party service providers located overseas or
have related parties located overseas, for purposes connected to your membership or the
services we provide to you. These third-party service providers may be located in the
Netherlands, the United Kingdom, the United States of America or other countries where such

6.1 Where we disclose personal information to third parties, we will take reasonable steps to
ensure that they comply with the Act, including the APPs, and this privacy policy, including,
where the recipient is located overseas (unless the overseas recipient is subject to a binding
legislative regime that is as effective as, or substantially similar to, the Australian privacy
regime). - Security and retention of personal information
7.1 We are committed to safeguarding your personal information and take reasonable steps to
protect it against unauthorised access, disclosure, or misuse. Information is stored securely in
electronic or physical formats, and access is restricted to authorised personnel.
7.2 When your personal information is no longer required for our business purposes, or as required
by law, we will take steps to destroy or de-identify it securely. - Cookies and Web Analytics
8.1 When you visit our website, we may collect certain information such as server address, browser
type, operating system, website visited immediately before coming to our site, the pages you
accessed on the website, how long you visited, the date and time you visited, your geographical
location and type of device used. This information is used in an aggregated manner to analyse
how people use our site, so that we can improve our service.

traffic to the website. We use Google Analytics to promote our goods and services, including by

8.4 Our website or app may contain links to other internet sites belonging to third parties and are
not subject to our privacy policy. You will need to contact those websites to determine their

9.1 You have the right to request access to or correction of the personal information we hold about
you. To do so, please contact us using our contact details below. We may ask you to verify your
identity before granting access or making changes. If you are dissatisfied with our response, you
may escalate your concerns to the Office of the Australian Information Commissioner (OAIC).
9.2 We will provide access to the personal information that we hold about you except in limited
circumstances (for example, if providing access would have an unreasonable impact on the
